Welcome to Nanny Reserve. These Terms of Service (“Terms”) govern your use of the Nanny Reserve website (nannyreserve.com) and our nanny placement and booking services (collectively, the “Services”). By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

  1. Overview

Nanny Reserve (“Nanny Reserve,” “we,” “us,” or “our”) is a Florida-based company that connects families with vetted, professional nannies. These Terms apply to all users of our Services, including families (“Clients”) and childcare providers (“Nannies”).

  1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services. Nannies must meet all requirements of our 10-Point NannyScreen Process and maintain any certifications or qualifications represented to us during screening.

  1. Service Description

Nanny Reserve connects families with vetted, professional nannies. Unless expressly stated otherwise in a written agreement, Nanny Reserve is not the employer of the Nannies. Families and Nannies enter into their own work agreements, and Nanny Reserve is not a party to those agreements. We do not control, and are not responsible for, the terms of employment, compensation, scheduling, or working conditions agreed upon between Clients and Nannies.

  1. User Responsibilities

Clients agree to:

  • Provide accurate and complete information during booking and registration
  • Treat Nannies with respect and professionalism
  • Communicate scheduling changes or cancellations in a timely manner
  • Provide a safe working environment for Nannies
  • Comply with all applicable employment, tax, and labor laws in their engagement of Nannies

Nannies agree to:

  • Represent themselves, their qualifications, and their experience honestly and professionally
  • Provide dependable, attentive, and safe care
  • Maintain current CPR/first aid certifications where represented
  • Communicate scheduling changes or cancellations in a timely manner
  1. Bookings, Payments, and Cancellations
  • All bookings must be made through Nanny Reserve. Bookings made directly with a Nanny introduced through our Services may result in termination of access to our Services.
  • Payments are processed securely through our third-party payment processor. By submitting payment information, you authorize us to charge the applicable fees.
  • Cancellations and rescheduling are subject to the cancellation policy presented at the time of booking, which is incorporated into these Terms by reference.
  • Refunds are issued in accordance with the cancellation policy applicable to your booking. Service fees may be non-refundable as disclosed at the time of booking.
  1. Screening Process

All Nannies undergo our proprietary 10-Point NannyScreen Process. While we take great care in vetting Nannies, screening is based on information available at the time it is performed, and we do not and cannot guarantee the future behavior, performance, or conduct of any Nanny, or any particular outcome of any placement. Clients are encouraged to conduct their own interviews and reference checks before finalizing any engagement.

  1. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANNY RESERVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM CHILDCARE ISSUES, MISCOMMUNICATION, PERSONAL INJURY, OR THE ACTIONS OR OMISSIONS OF ANY NANNY OR CLIENT.

IN NO EVENT SHALL NANNY RESERVE’S TOTAL LIABILITY TO YOU EXCEED THE TOTAL FEES PAID BY YOU TO NANNY RESERVE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

We encourage all parties to maintain appropriate insurance coverage.

  1. Intellectual Property

All content on our website — including logos, images, text, graphics, and the Nanny Reserve name and branding — is the property of Nanny Reserve and may not be copied, reproduced, distributed, or used without our prior written permission.

  1. SMS Communications
  • We will never send you marketing text messages.
  • We will only respond to text messages you send us, and we will send you reminder text messages for your upcoming appointments.
  • Message and data rates may apply. Message frequency varies based on your bookings.
  • You may opt out of text messages at any time by replying STOP. For help, reply HELP or contact us at info@nannyreserve.com.
  • Consent to receive text messages is not a condition of purchasing any Services.
  1. Termination

We reserve the right to terminate or suspend access to our Services at any time, for any reason, including violations of these Terms, without prior notice. Provisions that by their nature should survive termination (including Sections 7, 8, 9, and 13) shall survive.

  1. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved by binding arbitration conducted in Florida under the rules of the American Arbitration Association, except that either party may bring an individual claim in small claims court. You agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

  1. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles.

  1. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
